The Top 3 Reasons to Use a Buyer’s Agent:


1. You become a client, NOT a customer


A buyer will get the highest level of representation only in an agency relationship. If you do not hire an agent on your side of the transaction, you are nothing more than a customer to the seller and their agent.


According to the National Association of Realtors, “As a customer, a buyer is not represented by an agent… the agent cannot negotiate on the buyer’s behalf nor reveal to the buyer any confidences of the client, the client is the seller.”


Without your own representation, you are just a customer of the seller and their agent. Their job is to sell you specific homes at the highest price and best terms for the sellers they represent. The loyalty of the agent is to the seller, not to you.


2. You and only you are being represented.


The second reason to hire a Buyer’s Agent is to clarify that in your transaction, you and only you will be represented by your agent. (And preferably by the broker as well.)


By signing a Buyer Agency Agreement, you establish a contractual relationship with the brokerage that makes the broker and the agent you are working with legally accountable to you.  


However, if you hire a Buyer’s Agent from a company that also lists property, you will want to find out what happens to your representation if you should happen to become interested in a property listed for sale with that agent, or if you are interested in a property listed by another agent in the same company. Many reputable companies will allow you to seek representation from a different agent or from a brokerage whose loyalties will not be divided.


In an ideal world, you would find a competent Exclusive Buyer Brokerage to represent you. Exclusive Buyer Brokerages do not list homes or represent sellers. This assures you that you, and no seller, will be represented in your transaction.


If there is not a good Exclusive Buyer Brokerage available in your area of interest, we recommend finding a Buyer’s Agent with policies that meet your satisfaction regarding how any conflicts of interests that may arise will be handled.


NOTE: Many traditional brokerages use an agreement form with buyers that contains something like “Exclusive Buyer-Brokerage Agreement” as the title. This does not necessarily ensure that you are hiring an Exclusive Buyer Brokerage. Often, the word “exclusive” in the title simply means that you are committing to hire the brokerage as your exclusive agent. (Meaning they are the only brokerage you are committing to work with.)


3. Most sellers have agents watching out for their interests. We watch out for yours.


The seller’s agent is legally obligated to get the most money for the seller. There is absolutely nothing wrong, or evil, about this. That is what they were hired to do.


But can the seller's agent who was hired to work in the best interest of the seller also work in the best interest of the buyer? They cannot.


A seller’s agent, by law, must work in the best interest of their client. They must pass on any information they know about the buyers to the sellers. This includes information that may hurt your ability to get the home at a lower price or better terms.


Exclusive Buyers Agents do not work for sellers. They work for buyers only. They are looking out for YOUR best interest. They share with you any information they learn about the seller’s situation that could lead to a better outcome for you.
